Either (1) non-tidal rivers, streams and their lakes and impoundment, including adjacent wetlands, that are located above the headwaters; or (2) other non-tidal waters of the United States, including wetlands, that are not part of a surface tributary system to interstate waters or navigable waters of the United States.
